Ask Ohio’s U.S. senators to vote NO on the David Hamilton cloture vote.
President Obama’s first appeals court nominee an activist, an ideologue – NOT federal appeals court material.
Friday, November 13, 2009 – Earlier this week Senate Majority Leader Harry Reid said that he would call for a cloture vote to cut off debate on President Obama’s first federal appeals court nominee – David Hamilton.
That vote is expected to take place on next Tuesday, November 17.
Who is David Hamilton?
- He is the person who, as an Indiana trial judge, has ruled against abortion waiting periods, against permitting chaplains to offer Christian prayer at the Indiana state house, and against stiffer regulations for sex offenders.
- He is the judge whose radical decisions have been overturned numerous times by the 7th Circuit Court of Appeals, the very court to which President Obama now has nominated him.
- He is the former head of the ACLU’s Indiana chapter.
- He is the judge who, when initially appointed by President Clinton to a district judgeship in Indiana, was rated “not qualified” by the American Bar Association.

“Part of our job here as judges,” wrote Hamilton, “is to write a series of footnotes to the Constitution.” He went on to reiterate the belief that it was the role of the federal district courts to amend the constitution through their decisions.
This is totally unacceptable. It is the role of judges to apply the law, not make it!

David Hamilton is a liberal judicial activist who has let us know – through his history on the bench and his own writings – that he would make decisions based on his personal politics and agenda rather than on the Constitution.
In announcing his nomination, President Obama said that Judge Hamilton would set the tone for future nominees. This is cause for grave concern. Our senators must let the president know now that nominees in the Hamilton mold will not be confirmed.
