SCOTUS to Biden Administration: OSHA Mandate is Unconstitutional

WASHINGTON, D.C.—Today the Supreme Court granted a stay prohibiting the Emergency Temporary Standard (ETS) of the Occupational Safety and Health Administration (OSHA) mandate. This ruling will allow businesses to have the freedom to manage their workforce as they see fit.

Last week Center for Christian Virtue (CCV) joined 30 other family policy councils across the country in an amicus brief urging the Court to stay the mandate. The Court addressed the question of who gets to decide these matters and found strong legal basis to limit agency overreach and preserve congressional authority as protected by the Constitution. “Although Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,” the Court’s opinion states.

“The principles of business independence and personal liberty for which we advocated are preserved in the Court’s ruling today,” said John Hart, CCV General Counsel, “but the work continues as we monitor this and other issues.”
